Photography Terms & Conditions

These terms apply to photography services provided by Ruby Eliason Photography.
Booking
A photography session is not considered confirmed until the required booking process has been completed and any requested booking payment has been received.
The remaining balance must be paid by the date stated on your invoice or booking confirmation.
Photography sessions
Session durations are approximate. I will always aim to create a varied and meaningful collection of photographs, but no specific photograph, pose, expression or number of usable images can be guaranteed unless expressly included within your chosen package.
My approach is relaxed and documentary-led, particularly when photographing children. Children are not expected to perform or cooperate in a particular way.
Artistic style
By booking Ruby Eliason Photography, you acknowledge that you have viewed my portfolio and are familiar with my photographic and editing style.
Selection and editing of the final gallery are at the photographer's artistic discretion.
RAW or otherwise unedited files are not supplied.
Image selection
Where your package includes a specified number of digital photographs, you will be able to choose those photographs from your finished gallery.
Additional photographs or a complete-gallery upgrade may be available to purchase.
Delivery
Your finished gallery will normally be delivered within the estimated timeframe communicated at booking.
Occasionally circumstances outside my reasonable control may cause a delay. If this happens, I will keep you informed.
Copyright
Copyright in photographs created by Ruby Eliason Photography remains with the photographer in accordance with applicable UK copyright law.
When digital photographs are purchased, clients receive permission to download, display, share and print those photographs for personal use.
Images may not be commercially reproduced, sold, substantially altered or provided to another business for commercial use without prior written permission.
Client privacy and portfolio use
Booking a session does not automatically give Ruby Eliason Photography permission to use identifiable photographs of you or your children for promotional purposes.
Where I would like to use photographs on my website, portfolio, social media, advertising or other promotional material, appropriate permission will be requested.
Client responsibility
Clients are responsible for arriving at the agreed location at the agreed time.
Significant lateness may reduce the available photography time where another booking or other commitment prevents the session from being extended.
Parents and guardians remain responsible for supervising children throughout the session.
Weather
Outdoor photography is naturally weather dependent.
Light rain, cloud or changing conditions will not necessarily require a session to be cancelled. Where conditions are unsuitable or unsafe, we will discuss an alternative location or rescheduling the session.
Illness and emergencies
Please contact me as soon as possible if illness or an emergency prevents you from attending.
I will always try to find a reasonable solution.
If I am unable to photograph your session because of illness, emergency or circumstances beyond my reasonable control, I will offer an appropriate alternative date or, where an alternative cannot reasonably be provided, refund payments for services that cannot be supplied.
Prints and products
Colours and cropping may vary slightly between screens and physical printed products.
For the best representation of my work, professional prints and products are available through your gallery where offered.
Liability
Nothing in these terms excludes or restricts liability where doing so would be unlawful.
Ruby Eliason Photography will exercise reasonable care in providing photography services and safeguarding image files but cannot guarantee indefinite storage of photographs after final delivery.
Clients are strongly encouraged to download and maintain their own backups.
Changes
These terms may occasionally be updated. The terms applicable to your booking will be those provided or agreed when your booking is made.
Governing law
These terms are governed by the laws applicable in England and Wales.
Nothing in these terms affects your statutory consumer rights.
